Legal Question in Civil Litigation in Massachusetts
Returning Gifts After Breakup
I recently ended a emotionally controlling abusive relationship with my ex-boyfriend. He know wants everything he gave me back which includes a car he payed $4,500 for and he had the Title put in my name. He also bought me a clothes dryer,an amoire and coats for my daughters. He has never lived with me. He is threatening me with legal action if I do not give him everything back including the car. What am I required to give back to him? Thank you.

Re: Returning Gifts After Breakup
The title has passed to you on all items. Boyfriend is deluded. Unless the gifts were EXPRESSLY conditioned on marriage, and EXPRESSLY given with no other occasion in mind (e.g., mixed Christmas/engagement gift), boyfriend loses in court. THe courts don't even like dealing with such issues, despite the relatively clear case law.
I suggest that you get an attorney who practices in your county to write a stern letter warning of potential legal consequences of continued threats, as well as the costs of improper litigation.

As attorney Lee said, barring any unique circumstances, the law does not entitle a person to seek the return of a gift.
You should retain an attorney who can strongly persuade your ex boyfriend not to take any further action.
