In Massachusetts the statute that governs this conduct is:

Chapter 272: Section 4. Inducing person under eighteen to have sexual intercourse

Section 4. Whoever induces any person under 18 years of age of chaste life to have unlawful sexual intercourse shall be punished by imprisonment in the state prison for not more than three years or in a jail or house of correction for not more than two and one-half years or by a fine of not more than $1,000 or by both such fine and imprisonment.

To violate this law is dangerous and could well brand the violator as a "sex offender" for life.

I agree with that the other attorneys have said. The only exception I can think of would be if the two individuals successfully petitioned the court in advance for the right to marry each other, and of course the marriage actually happened. Then, they could legally have sexual relations as man and wife. Other than that, what your son is talking about is still classified as statutory rape in Massachusetts.
