Legal Question in Civil Litigation in Massachusetts

Hi, my name is Steve and i drive a oil truck in middleboro ma, and a few months ago i delivered oil to the wrong house! So i told my employer who in turn, called the residents and said we were sorry for the mistake and we could offer them rack price(the price my employer pays for the heating oil) and a reasonable amount of time to pay for the oil. The residents have not returned my employers repeated calls. I had to pay the bill myself. Is there any legal recourse i can pursue? Thank you.

How much money are you talking about? I do not think it is legal for your employer to have made you pay the money. Your employer has a claim against the homeowner for the fair value of the oil. If the employer does not want to pursue it, you may want to have the employer assign you its rights. However, the whole thing may not be worth pursuing if the money is not signficant. As an initial matter, I would ask the employer to write a letter to the homeowner demanding to be paid. Good luck.
