Legal Question in Civil Litigation in Massachusetts
Time frame to file suit
I would like to know how long it should take a law firm to file suit against a contractor. I have been waiting for two weeks now and in that time the contractor has closed his business disconected all his phone lines including residential. I do not want to seem pushy but this guy is getting ready to split and I want to catch something before he leaves town. My lawyer has his bank info but I am afraid by the time the lawyer gets this case together, someone else will file before me and the contractor will close his accounts. Should this be taking so long?

Re: Time frame to file suit
Two weeks is not unreasonable per se; the important thing is to be in contact with your lawyer so you have confidence that your interests are being protected. On a practical level, the courts are unlikely to move fast enough to stop assets from being dissipated or moved out of state, unless a whole lot of money is involved and you can get a receiver appointed or commence an involuntary bankruptcy action.
