Legal Question in Civil Litigation in Massachusetts
If I am a victim in an assault and battery case and the accused tries to sue me for glasses that were broke in self defense, am I liable? He was arrested and I was granted a restraining order. He has continued his pretrial, but in the mean time has said he wants to sue me for eye glasses that were broke while I was trying to flee him. He was in my vehicle when the assault occured, he came in without my permission and would not leave and assaulted me. He filed a criminal complaint against me where they found "no probable cause" but they said he could try to civilly sue me for the glasses that were broken. What do I do? He has a private lawyer and wealth, I just have the truth. Im not sure even where to begin. This is in Massachusetts.

If he sues you at all, he would do it in small claims court, where you don't need a lawyer to defend yourself, and where I doubt that he would hire a lawyer just to try to get payment for his eyeglasses. If you end up in small claims court, you both will have an opportunity to tell your different sides of the story, and you can explain that the glasses were broken in self-defense during an attack.
