Legal Question in Health Care Law in Massachusetts

I currently have BCBS of Florida for insurace. I live in MA. We need infertility treatment which is not covered by our current plan. The plan does cover other child birth related stuff, ( pre-natal care, delivery, etc. ) As I understand it MA law requires any health insurance company that provides those other benefits to also cover fertilty treatment including IVF. My company is based in MA but the parent company is based in FL and we get our benifits through them. Is BCBS of FL required to comply with MA law if my business is based out of MA but the medical insurance is based out state? Thank you for your time - MG

Hi MG,

As a general proposition, I agree that G.L. 175, s. 47H would require the insurer to provide infertility treatment for insureds, like yourself, living in Massachusetts. Have you raised the issue with HR or BCBS Fla.? I would happy to discuss this matter with you.
