Legal Question in Immigration Law in Massachusetts

F1 student renew visa

Hi, I have been in US for 5-6 years now. I am on a F-1 status and currently pursuing my Master's degree (I have always been on F-1 and have a valid I-20 from my graduate school).

US consulates issue 1-year student visas for my country of origin and I have never renewed my original first issued visa and I have been back home only once when the visa was still valid (visa expired in 1999).

I would like to go home for a quick 1-2 weeks visit due to family related matter but back home one needs to set an appointment in writing with the embassy at least 10 days ahead to get a visa and I would not have the time to apply while there. I was thinking I could renew my visa in Canada where I can set the appointment via Internet.

Do I run any risks by going to Canada? I have heard of different students were not issued visas, where would the counsel at the embassy base the decision? I do not want to jeopardize my last year in graduate school so I would really appreciate a response. Thank you in advance

Re: F1 student renew visa

If your I-20 is still valid you should be able to obtain a visa at a U.S. Consulate in Canada. However, Consular practice is notoriously inconsistent in its adjudications and if for any reason you are found not eligible you will not able to re-enter the U.S. until a visa is issued.
