Legal Question in Immigration Law in Massachusetts

Can a foreigner on a student visa own a minority part of, or work for a USA based company? Would owning part of the company or working for it, have any implications on his student visa status?

You can invest in the company, but you cannot work for the company.

In order for a foreign national to be authorized to work in the United States, they must have explicit permission from USCIS, either through an H-1B, E-2, OPT, etc. So I do not advise that you work for this company while you are in F-1 status.

Depending on the country you are from, and if you own at least 50% of the company, you may be eligible for an E-2 visa.

I suggest seeking representation before you file anything, though. Please let me know if you have any further questions. Thank you.
