Legal Question in Immigration Law in Massachusetts

H1 Visa - Sponsoring

I am an architect from India who did her Masters from Carnegie Mellon, Pittsburgh last year. I am right now on OPT and working voluntarily at a small architectural firm. Now another company has offered me a job, but wouldn't pay for my H1? Can they sponsor my H1 if I pay for it ? And what all documents would be needed from that company to sponsor my visa/petition ?

Depending upon the size of the firm, they would need to pay either $750 or 1500, but the rest you can pay for. You need to submit documentation of your qualifications and the requirements of the position to establish it is an H-1b qualified position. If you would like more information please contact my office.

There are certain fees that the employer must pay. The employee can pay for the H-1B and fees allowed to be paid by the employee if the amount being paid by the employee does not drive the wage offered by the prospective H-1B employer below the Federally mandated Prevailing Wage. The documents required for the H-1B include all of the information about your academic credentials and information about the prospective H-1B employer. If you would like to receive the checklists by e-mail, please feel free to contact us at [email protected].

The employer is only obligated to pay the training fee of $750/$1500 (depending upon the size of the company).

You are allowed to pay everything else. Comprehensive information can be found here:
