I-751 Waiver File

Respected Sir/Madam,

I came in Atlanta , GA by CR1 category in Nov2004 But within a one month my wife started to ignored me and wanted Divorce cause she has other boyfriend. so i moved to my uncle's home Boston,she told me to go to Bosoton. I lived with my wife in India 2 months and In Atlanta, GA one month.

My marriage was arranged and traditional in Jan 2004 in India.we had a honeymoon in India. After marriage my wife came to Atlanta ,GA and she had abortation Operation when i was in India and it was my baby.

my conditional residence will be expired in Nov 2006.

I hv file for Divorce and my Divorce will be finalized (irretrievable Breakdown) in arround Nov. 2006

Is it possible to approved my I-751 waiver? and how many percentage of chance to win ?

I hv many wedding picture and movie, love letters wich i wrote her from india , joint travel bill from inda, relatives affidavits, joint donation bill from india, phone card bill, marriage certi, marriage bills.I hv Social Security application conformation letter from Atlanta ,GA. I do not hv any joint bill from Atlata, GA.

I m not in the fault, i want to live with my wife but she does not let me. i hv been in Boston Since last 1.5

years. what i need to do? pls,thank u

The regulations allow for a waiver of the joint filing of the I-751 if you are able to establish that:

1) Deportation or removal from the United States would result in extreme hardship;

2) The marriage was entered into in good faith but the marriage was terminated and you were not at fault in failing to file a timely petition; or

the marriage was entered into in good faith but during the marriage you were battered by or subjected to extreme cruelty committed by the citizen spouse.
