Legal Question in Immigration Law in Massachusetts

marrying an illegal alien who arrived legally

My girlfriend arrived in the US legally some time ago. She was in the process of finalizing her divorce with her husband in her native, Central American country, when she arrived. We met, feel in love over time and now wish to get married. 2 problems however now stand in our way.

1)since we met her visa has expired and

2)her ''husband'' caught wind of our relationship through the grapevine and has stonewalled the divorce proceedings out of spite.

Do we have any hope of getting married? I am told he may be able to drag this out for years being that the laws in his country are not as slanted toward the rights of the wife as they are here.

You can always get a divorce in the US bwhy somewhere else. Then get married..and apply for spousal petition.
