Legal Question in Immigration Law in Massachusetts

When passport expires, does visa too?

I'm in USA on J-1 visa which expires in october 2002. Before my visa expires I want to apply for H-1A visa. My passport expires in June 2003. What's gonna happen with my H1 visa (let's say I got one)when my passport expires? Wiil I get one in my new passport or will I loose one? What's the best thing for me to do?

Re: When passport expires, does visa too?

Most likely you'll do a change of status while still in the U.S. from J-1 to H-1A visa. You'll get an approval notice and new I-94 from the INS. The new I-94 will contain the new date your stay is authorized until in H-1A status. Your passport won't matter but you should get it renewed with your country's consulate.
