Legal Question in Insurance Law in Massachusetts

auto accident

my son was a passenger in a car on 01/10/00, the car was hit and my son and the driver went to the hospital. when the hospital asked my son if he had ins he said yes and gave my medical ins co cigna to the nurse. i have never received any invoices from the hospital or anywhere until yesterday, my son received a letter from a collection agency for the copay of $25.00. my question is, shouldn't the drivers ins company pay for all medical bills related to this accident? please let me know what i can do about this.

If the car your son was in was registred in MA, it is required to have insurance. One of the compulsory coverages is PIP - no fault. Your son should get PIP coverage from the car owner's insurer. Tell the bill collector there is insurance and give them the chore to chase it.

I recognize that the principle of getting this bill is disturbing, but think for a bit about what has happened, and focus on whether your son suffered pain, whether he will need therapy in the future, and whether you should be looking to recover for these damages. Few attorneys will work to recover $25, if you want to pay an attorney several hundred dollars an hour to do so, they may wonder.....
