Legal Question in Insurance Law in Massachusetts
damage by towtruck
My 1991 Saab Turbo, was towed this morning to my (approx. 30 miles) mechanic's shop, under the auspices of American Automobile Association. The car was towed in due to an overheating issue.
My mechanic called to tell me the oil pan, had been hit by the tow gear and the pan is damaged beyond repair. Cost to replace $600.00. He said the oil pan, clearly show the damage. The towing company has not repsonded to my calls at all. Triple AAA, says Not their issue. They do not cover tow damages, even though they refuse to send out flatbeds for Saab Turbo's.
This mechanic has been dealing with this car for over 9 years, and has a stellar reputation within the auto community.
What is my recourse?

Re: damage by towtruck
Did the police call the tow company or did you or did AAA call them?
If this issue is not already solved, please send me the name of the towing company (so that I can check that I don't have a conflict of interest) and then contact me or an attorney closer to you for further assistance.
Re: damage by towtruck
I think you should sue the tow company in small claims or in district court. Get the exact specific legal name of the tow company and go to the courthouse and get a complaint and speak with the clerks about having it served. It will be some effort but you should be made whole - if the proof is as you say it is. :)
