Legal Question in Insurance Law in Massachusetts
My father is the executor of estate after his fathers death. He was the sole beneficiary on his fathers life insurance policy. He is consulting with a lawyer about the estate and the lawyer keeps asking if his father had a life insurance policy....why does the lawyer ask ? Does he have to disclose this to the lawyer ?

Thanks for your question. The lawyer needs to know who the beneficiaries of the life insurance policy are, and lawyers prefer to review documents themselves rather than placing the burden on their client to make a determination or judgment. If there are no beneficiaries, then the funds will flow through the estate. Either way, the benefit may be taxable and it is important for the lawyer to know these things. It is not strange that the lawyer is asking for more information about a life insurance policy and even more so if he gets the feeling that his clients are keeping something from him. If you don't trust your lawyer, you have every right to hire a new one. Best of luck and please accept my condolences on your family's loss.
