Legal Question in Insurance Law in Massachusetts

Hi,

I have insurance situation on a home-owner's policy. I made a claim three years ago, during the severe ice storm we had. During the storm a large tree fell on my house and damaged my roof. i hired a public adjuster to help me with my claim. I hired them to evaluate my damages to make sure i got all my damages repaired under the terms of my insurance policy. To make long story short they messed up on the claim. They failed to recover on several issues but the biggest issue was there was more structural damage to the roof than the public adjuster and insurance adjuster allotted for repair. I would not even have gotten any money for structural damages to my roof if I was not insisted that they inspect the attic rafters for damage. After that inspection the insurance company cut a supplement check to me 6300.00 for structural repairs to my roof. make matter worse that check was issued in wrong name and the adjuster never to this day have had that check reissued.(still do not have this money) Two months ago when my adjuster had not finalized my claim i had structural engineer do an inspection of my roof. He found as i had insisted in past that the whole roof has to come off and be rebuilt. It was heavy damaged and that it would cost more to repair the roof than to replace the roof with whole new one and further the old roof does not meet current building codes. i have code upgrade on my policy so that should not be an issue. (there is more than 40,000 Plus in damages not paid just in roof issue)

What are my options if any to get my damages repaired properly/ Do i have case against the public adjuster? The insurance company is saying the claim is closed because it is more than two years old. Do they still have an obligation to me even after two years?

I think you have no choice but to bring your whole file to an attorney focusing on insurance coverage disputes. Whether the claims handling was proper is another issue, as is the issue of whether the public adjuster was negligent. I am happy to discuss your case with you.
