Legal Question in Insurance Law in Massachusetts
Law Against Having Two Insurances
My husband has family coverage at his job but I also want family coverage at my job as a second insurance.
I am being told that it is against the law to carry two medical insurances in Iowa. I would like to know if this is true. I moved here from Ala. so I do not know the laws of this state. Please advise me of my rights.
Thank You,

Re: Law Against Having Two Insurances
I don't know of any such law. There might be one, but I don't think so. I'm just not sure.
I am sure of this: if you tried to actually collect from each, you would VERY LIKELY be breaking the law and you might have another problem: one and possibly both policies are likely written to say that they will not pay where another policy is available to pay -- they call it 'insurer of the last resort' or 'pick-up policy' or something like one of those. It's possible that neither would pay for some large calamity when each found out about the other. But the main thing is that no claim should (or probably could) be made to both companies. The providers (doctors, hospitals, pharmacies) probably can't even do a double billing, so it may be moot unless you tried to pay first and then collect from both insurers.
Is your husband enrolled in his favorite HMO or PPO or whatever, and you just want to keep yours?
Is either of them Harvard Pilgrim or Harvard Vanguard? I'm sure you've seen the news lately and that could affect and even excuse the odd behaviour of having two family policies in effect.
You may reply directly to me if you need more. I can look up the law for you but it would take me a little time ... and you know what that could mean!
