Legal Question in Insurance Law in Massachusetts
life insurance overpaid and wants $ back
Four months ago my father passed away & I was the sole beneficiary of his life insurance. The claim was filed & I received an account with a ''certificate of account balance'' stating total opening balance of 75K. Two months later, after calling and verifying the available amount of 75K & interest, I transfered this amount into my own account. Last week the insurance company sent me a letter saying ''our records state we have released 50K to you((not right! they released 75K!))...& we are denying your claim for the additional 25K'' because my father, tho paying for a 3xyearly wage level of insurance through his employer, as well as providing preliminary evidence of insurability, was asked to submit additional info, but died before he could do so.
My question is: do they have the right to release 75K to me and take 25K back, when it seems to be their mistake in releasing the initial amount to me and leading me to believe this was the amount I was receiving?? I have made important decisions and purchased a car that I never would have paid so much for if I knew the insurance co was going to take money back!!
