Legal Question in Insurance Law in Massachusetts

While legally parked on a side street, my car was hit head on by another car travelling in the opposite direction (the other car crossed over to the wrong side of the road.) When the accident was discovered there was nobody in the car but the key was in the ignition. When the owner was notified of the accident he claimed that the car "must have been stolen." The other owner acknowledged that he left an ignition key in the car and that the doors were unlocked.

My question is, since I have only limited insurance, nothing to cover this, is his insurance liable for the damage to my car (its totalled)?

Do you believe his story, that he left the keys

in the car and then later didn't even know that it

had been stolen?

Yes, the owner should be liable. His insurance might

not cover his liability, though, based on that story.
