Legal Question in Intellectual Property in Massachusetts
Back in 2004/2005 I had put together a photo gallery of collectibles. Included in that gallery were my own pictures. I had been sent other pictures that were donated. Since I was putting it together, I had written the terms in which the pictures were donated. I had written them so that the full ownership was still under the photo owner and that the gallery could only use them with permission. This was worded this way in case the owner of the photo wanted the photos pulled for any reason.
I am no longer running the gallery. Since then the photos donated were watermarked without my permission (I have 100 photos on there). And they have changed the terms in which people donate. Now they claim ownership to photos donated. I never agreed to these terms nor did they ever contact me to tell me about the change.
Now I want the photos pulled I have made every effort to contact them. After they told me no they refuse to correspond with me. I want my photos pulled. Is there a legal way I could have my photos taken down off their site? I am the copyright owner of them and they did put their name on my photos.
Thank you,
Jennifer
