Legal Question in Intellectual Property in Massachusetts

Patent Ownership

We would like to patent a product but want anonymity for our current business. We are thinking to set up a new corporation to handle this portion of the business. Can a corporation file the patent or does it need to be an individual?

Re: Patent Ownership

Ownership is easy -- can be any person (whether natural or juridical); however, the inventors must be listed as individuals irrespective of whether the patent would be owned by a corporation.

Re: Patent Ownership

A patent application must be filed in the name of the true investor(s) as an individual(s). Corporations/business entities cannot file a patent application. However, corporations/businesses can certainly own a patent - the application, the issued patent, and all rights in the invention. This is accomplished by way of the inventor assigning his rights to the entity and filing the assignment with the Patent Office (USPTO).
