Legal Question in Intellectual Property in Massachusetts
publishing a paper after patent application
I'm trying to convince my company
to allow me to publish a paper on
software ideas that I worked on for
few years, night and day, to develop
and construct. And later, the
company had filed a patent
application on it. My argument for
letting me publish it is that it will
become public anyway after 18
months. Now that it's been filed, is
there a way for them to change the
''public in 18 months'' provision. Any
help on how I can convince my
company to allow me to publish my
work would be appreciated. I also
feel I've not been compensated
sufficiently for this work. My work
has resulted in significant gains for
the company ? What legal methods
or rights do I have to (a) publish a
paper, OR (b) be compensated
monetarily for not letting me publish
it.

Re: publishing a paper after patent application
Likely you have no rights other than to be included as an inventor, assuming that your work was performed within the scope of your employment. Best, however, to consult with a patent attorney to evaluate your situation. Cheerio!
