Legal Question in Intellectual Property in Massachusetts

Last year, a local publishing house published a book of my poems. I was given 300 copies

and told that if I sold any, the sales money was mine. I just found out a lot of copies have

been bought over the last year from the publisher, who told me she had sold "only 7".

I have received none of the sales money from books bought by customers through

the publisher. I never told the publisher she could keep sales money from copies she

sold. When I asked her reasonably about this online, she went offline. I called her to

ask the same questions and she hung up on me. What can I do legally now? I am

shocked. This woman has obviously been stealing from me.........

Any attorney will say you need to send the publisher a certified demand letter. It should summarize the situation (her avoiding you, etc.) and give her a short period of time (a week or so) to render of accounting of your book sales along with any payment due you. If she doesn't comply then sue her, and make this plain in the demand letter. Consult with an attorney in your area for specifics.
