Legal Question in Juvenile Dependency in Massachusetts

CA and MA guardianship laws

A friend of mine who has graduated from high school early wishes to move from her home in California to an apartment, with some friends over the age of 18, in massachusettes. Being only 17 years of age, must my friend obtain a legal guardian in massachusettes in order to live there, or can she move out of state and live indipendently of her parents, with their permission, even though she is not legally an adult? any specific information on california and massachusettes guardianship laws would be appriciated, also.

Dear Inquirer:

Nothing herein shall create an attorney-client relationship, unless a written retainer agreement is executed by the attorney and client. This communication contains general information only. Nothing herein shall constitute an attorney-client communication nor legal advice. There likely are deadlines and time-limits associated with your case; you should contact an attorney of your choice for legal advice specific to your personal situation, at once.

The site contains quite a bit of general information about California Family Law, Tenants' Rights, and Juvenile Dependencies, as well as information about me (education, experience, et cetera) and my office (location, hours, fees, policies).

NOW, IN RESPONSE TO YOUR INQUIRY --

The situation you describe is not unlike that of a minor who "goes away" to college. Normally, no legal action is required if s/he has her/his parents permission. In the alternative, this person could become an emancipated minor under California law (provided she is able to support herself). See California Family Code section 7000 et seq.

Thanks for sharing your interesting inquiry with us on LawGuru, and good luck with your case.
