Legal Question in Juvenile Dependency in Massachusetts

possession of alchol underage

Can the police arrest a teenager at a party where some kids are drinking and charge them with possesion if that kids was not drinking, was not intoxicated, and never even held a can of beer. There was no pictures, no breath tests just name taken of all kids and everyone was charged.

Yes --

Possession is a techincal term that does not only means that the container or the bottle is in one's hands. The ability to gain control or exercise control is also deemed as possession.

The facts you described are those that should be argued. You son or daughter may be eligible for a divesion program. That means that the child will not be charged or have a record, but if he does a program of some sort, then this whole matter will go away.
