Background checks

leagally can you check employees criminal records with or without their knowledge? I know you can check references but, what about any court or criminal records.

Contact the MA Department of Labor as to right of inquiry after job offer made. Against the law to ask on application for employment or in interview before offer of employment. Generally allowed where employee has access to money or to dependent individuals, e.g. childcare, nursing home,. etc.
