Continuously Delayed Paycheck
My employer, an Designer and Manufacturer of highly technical biomedical units, has fallen on hard times lately, and have been unable to meet the bi-weekly payroll on time for the past 2 months. Paychecks have been delayed anywhere from 1 to 2 weeks past their regularly scheduled date. 1.) How long can an employer hold a check due to NSF? 2.) Can one legally request to be laid off in order to be paid? 3.) How can they justify the hiring of a new employee when the regular existing employees are not getting paid?

Mass law requires payment of checks weekly or, if generally by-monthly then on that schedule. Call Attorney General's Section of Wage and HOur Administration. They can call ER and read the riot act.
