Legal Question in Employment Law in Massachusetts
Employer asked about religion after interview
I am writing to you in regards to an event that occurred during April 2001 to my fiance. He attended XX for his graduate degree and was excited to have an interview with a major computer firm on campus. My fiance is an Arab and is Muslim. He felt that the interview was excellent; everything went well. After the interview as he was leaving, one of the two men interviewing him walked out with him and while talking asked him what was his religion. Apparently he did not give the right answer because he was not hired. He emailed the college's career center representative but nothing was ever done about it. He did not even get an apology from the company. He is from XXXX, where it is common to ask these questions so he did not think too much of it at the time until. Some time has gone by now and he is hesitant to pursue this. Unfortunately he did not record the interview either so all he has is his word and the emails he sent to the college stating what happened.

Your fiance should go to the Massachusetts Commission Against Discrimination right away and file a complaint. Tell him to hold on to copies of those e-mails as well.

Unfortunately the time within which to bring an action for discrimination under both state and federal law has passed. It is 300 days with the Feds and six months with the state.
