can my employer use anything i have posted on my facebook against me if my facebook profile is private and they gained access to viewing my facebook without my concent?

Yes. An employer can terminate you for any reason, or no reason, at any time, unless you have an employment contract which provides otherwise or you have some sort of union protection. There is no law providing that an employer can only fire you if your security settings are for open access rather than by consent.
