Legal Question in Employment Law in Massachusetts
Equal Pay
I recently got laid off by my employer (50,000+ employees worldwide) during a reorganization. My job title & pay was that of a programmer - but my job responsibilities were that of a managers. I was managing several projects and senior employees. I have several documents (performance appraisal, emails) stating that I was serving as a Manager. I was always verbally promised of a promotion & pay raise. However, this did not happen and my division was let go during the reorg. My severance package was similar to that of a junior programmers even though I worked in the capacity of a manager for the last 2 years.
I am a female employee with disabilities. Do I qualify to sue my employer ?

Re: Equal Pay
Bycontinuing to work after your employer broke its promises you may have waived your rights to the title and raise. However, you should try to negotiate a better package based on those promises. If your division was eliminated, in fact, and non-disabled people were also terminated, a discrimination claim would be hard to establish but that doesn't mean you could file a complaint at the MAs.s Comm Against Discrimiantion
