Exempt hourly employee working extra hours

I am employed in a professional capacity 16 hours a week at an hourly rate. I have consistantly worked more than 16 hours, but my boss is refusing to allow me to take the extra hours as comp time (ie work 20 hours one week and 12 hours the next) or pay me for the extra hours. Am I protected at all?

Hourly employees are entitled to pay for hours worked, whether regular wages or overtime. Regular wages are covered under c.149, s.148 of the MA Gen Laws.

You should speak with your attorney if you want to bring an action. You may have a case entitling you to treble damages, attorneys fees and costs.
