There are a number of potential violations. A relatively new law in Massachusetts, the Harassment Prevention Act, potentially grants victims a harassment and bullying a cause of action for damages and attorney's fees in some circumstances. Depending on the nature of the bullying and harassment, and on who is engaged in the misconduct, other laws limiting discrimination in the workplace may apply. In some instances, claims for violation of Massachusetts Civil Rights Act, which limits interference with a person's rights through threats, intimidation and coercion may apply. Much depends on the particular facts and circumstances involved in each case.
