Legal Question in Employment Law in Massachusetts
Fired for Organizing?
I recently decided to quit my retail job because I believe I was
treated unfairly. Free classes were being offered to other
employees; I recived two performance reviews within 1 month,
while other employees scheduled to receive the ''yearly'' review
recieved none; and so on. My bosses objected to the fact that I had
other employees to my place to talk before a staff meeting about
raises, and even wrote in my review: ''[This employee] has
demonstrated some devisive and manipulative behavior with both
owners and co-workers. [S/he] needs to refrain from instigating
conflict.'' This seems to be in direct violation of collective
bargaining rights.
Another complicating factor is that my second review occured
within a week of me asking my boss not to touch me for the third
time, this time in front of a witness.
My bosses have no truly legitamate complaints against me , and
have employed me for over a year. Even though I was going to
leave in a week, they fired me anyway after a fellow employee said
that I was going to sick a watchdog organization on them. I said no
such thing. What resources should I appeal to and what are my
possible courses of action? Is there free representation for me?

If you are in a union, file a grievance. If not and were organizing call the Labor Department (Federal). If sexually harassed, separate claim for sexual harassment - file with MA Commission AGainst Discrimination. There is a fee for legal representation.
