Legal Question in Employment Law in Massachusetts

''Harrassment''

I would like to know if I have any legal recourse concerning a fellow employees continued refusal to perform certain job tasks because of personal issues. I have repeatedly asked my immediate superior, the general manager, for intervention and resolution in this matter. My job depends on constant communication with this person. She refuses to communicate, and has made my job practically imposssible to do. She has gone out of her way to make me look like an incompetant idiot to my staff and our guests, and has made the entire staff most uncomfortable with the situation. She has been the cause of another employee to leave her job, because she could no longer tollerate the verbal abuse. She has treated my staff just as poorly, and members of her staff who will not be returning to work next season because of it. This is not sexual harrassment, but a form of harrassment which is just as ''ugly'' I am not going to be forced to leave my position because this employee is being allowed to treat people any way she sees fit. My leaving will not solve the problem. Is there anything I can do?

There is no legal remedy available for the problem you describe. The law lets companies hire and retain bad managers. It's only when they are disriminatory or violate a public policy that it becomes unlawful.
