Legal Question in Employment Law in Massachusetts
Probable Cause
My collective bargaining agreement contains a clause that says where probable cause exists to beleive that sick leave is being abused they may request medical documentation. What is meant by probable cause?

Re: Probable Cause
It may be defined by the collective bargaining agreement (CBA) itself. If not, in the context of the CBA, it would mean that there is a reasonable belief that sick time is being abused, and that the person from whom they are requesting additional medical documentation is the person abusing their sick time.
