Legal Question in Employment Law in Massachusetts
I was recently working for a auto parts company full time through a temp agency. While in my 5th weeks of employment, my daughter got very ill and required emergency surgery. In the two days I was out I received a phone message from the temp agency saying that I was no longer employed because they needed someone who was going to be able to be there. I did inform them several hours before my shift at 8am (approx 1:30 am and again at 7:30am) that I was in the hospital and explained the situation. Is this legal? I wasn't not allowed to provide proof before they fired me. thank you.

Sadly, you probably signed an agreement with the temp. agency that gave them the authority to replace you anytime, and for any reason. However, you may have rights under the FMLA, and its Massachusetts counterpart. In order to know, you have to have an attorney review the contract.
