Legal Question in Employment Law in Massachusetts

Residency Requirements

My police dept requires its officers to live within eight miles of the center of the city. Other city employees have no such mandate. Is there 10th Cir case law to invalidate the PDs residency requirement?

Re: Residency Requirements

City may impose residency requirements on those departments where it feels it is important for the employees tio live near the city - e.g. police, firefighters, teachers. If City passed an ordinance it can be challenged in court. If state passed law it too can be challenged. I wouldn't hold out much hope. If law is recent and you were employed before it was effective, you may have been grandfathered so that the rule doesn;'t apply to you. Check with personnel.
