Legal Question in Employment Law in Massachusetts

vacation earnout pay

I work at a branch office in MA for a company that has it's headquarters in TX. They have just notified us by email that they will no longer pay out for earned vacation time upon termination of employment(either by voluntary or involuntary). Is this legal? Aren't there regulations by state or federal statutes that they must follow for this?

Re: vacation earnout pay

Earned vacation pay must be paid out upon termination of employment - regardless of the reasons of the termination. To answer your question, your employer cannot refuse to pay out this earned time.

If you work in Massachusetts and you have earned your vacation, then your employer must pay out the vacation amount to you regardless of the reason for termination or location of the company headquarters.
