Legal Question in Employment Law in Massachusetts

Viewing personnel file

I believe that according to MA General Law 149 a

tenure-track prof of a private institution is basically the

only type of person in the entire state not considered

an ''employee'' and therefore cannot gain access to his/

her complete personnel record.

Is this true? Is there another law that allows tenure-

track profs. at private schools in MA to see their

records? What about a federal law? The private

institution in question receives federal grant money and

its students receive Fed. student aid.

It just seems strange that of all the careers--from

surgeons to CEO's--junior faculty are the only ones who

can't see their record.

I don't know what source your relying on to say that you are excluded from c 149 provisions. In any event I suggest you contact the MA Higher Education Commission-may not be correct name, they keep changing it, but you should be able to locate in the blue pages of your telephone directory.
