Legal Question in Employment Law in Massachusetts
My wife is 8+ months pregnant. At about 6 months into it she was let go from her job. They said it was a layoff because of lack of work coming in but she was the only one laid off (as far as I know) and some employees who were hired after her were not terminated. About a year or so ago, another female employee was "laid off" right at the end of her pregnancy as well. Both the other employee and my wife travelled extensively as part of their employment. I don't think their terminations are a coincidence and I think that the company deliberately terminated them both for maternity reasons. Neither would be able to travel shortly before and for a time after the birth and so their roles and responsibility would have to change. My question is: Do we have an argument for wrongful termination or discrimination based on being pregnant, or anything like that? As you can imagine, my wife losing her job 3 months prior to our son being born has been a considerable strain on us financially and emotionally. I appreciate any insight you can offer.
