X-company is holding check pending ''investigation''

My husband worked for as a sales manager for a particular company for the last 6 months. He along with 5 other employees at his location were laid off under allegations of fraud. What they were doing is something they were trained by their manager to do, and required to do to keep their jobs. The company is now holding their last paychecks pending the outcome of their ''investigation''. Can they do this? Do we have any recourse besides the AG's office? No charges have been brought against anybody, and we are pretty sure that nothing can be proved, so no charges will be brought. One of the 6 recieved his paycheck, because he had just transfered and it went to a different location. Another was recieving direct deposit, and so recieved his money. Also, there have been lots of people fired in the past for much worse, and they all recieved their paychecks. By the way, the pay is commission based.
