Legal Question in Landlord & Tenant Law in Massachusetts
Breaking a lease
I had to move back to Texas because of a surgery and I had a lease from Oct.2002 to Sept.2003. I could not live in MA because I could not longer go to school. Do I have to pay for the lease for the life of the lease, even though I could only live there for one month? I paid for 5 months and I had a one month security deposit.

The answer to your question is in your lease agreement. I have seen leases that do require that all of the rent be paid through the end of the lease. If that is the case with your lease, you are at the mercy of your landlord.
Re: Breaking a lease
Once someone else moves in, the landlord can no longer charge you. Also, the landlord must make a reasonable effort to re-let the apartment as quickly as possible after you move out. Five months seems like a long time, depending on where in Mass. the apartment was.
