Elevators in my building

I rent in a large building in Boston. During my three years there the elevators have at best been spotty and at their worst they are not working at all. This has resulted in waits of up to 45 minutes to get an elevator to or from my apartment. On two of these occassions tenants asked for the stairs to be opened and the request was denied since it was not an emergency. I have complained numerous times and nothing seems to get done. What kind of recourse do I have?

This would appear to result in a serious habitability and safety issue. I would begin by complaining to the landlord, in writing, copy to the the City of Boston Inspectional Services Department. Send both certified mail. The landlord is not allowed to retaliate against you for this complaint.

If the issue is not addressed, a rather complicated statute allows you to withhold rent. I suggest that you obtain particular legal advice before invoking this statute.
