Evictions

Landlord wrote a letter stating that I have until june 20th to vacate property becuse he has sold property and new owner wants property cleared of all tenants. I have a small child at home and do not have funds to move out with in time frame. He also did not go through court so I can not get help from housing. What are my rights as a tenant with a small child who does not want to become homeless in sixty days?

You can refuse to move, quite effectively. This sounds like an illegal and ineffective termination. You cannot be forced out without court action. You should consult with a local attorney and get your options clear. At the very least, you should leverage this for some of your moving expenses.

You cannot be forced to leave without a court order. You have several options, including negotiating a payment to vacate the premises timely.

As long as your rent is paid current the landlord must give you a proper 30 day notice to quit and then file an eviction action in court where you can then ask the court for time to find another place for your family. You might also consider retaining an attorney to determine if the landlord has violated the law which might give you additional options or a least provide you someone who could knowledgeably negotiate with your landlord.
