Legal Question in Landlord & Tenant Law in Massachusetts

Is my ex-landlord breaking the law?

I sued my ex-landlord in MA small claims court for a security deposit that was not returned to me. The judgement was in my favor and she has until 7/27/05 to pay in total. On 7/17/05 she telephoned me and said if I do not back off she will sue me for $3500 in an unrelated matter (that has no merit). She wants me to notify the court clerk that the matter is settled and there will be no need for a payment review. I can't afford to enter a lawsuit to defend myself over her charges. I just want my deposit back. Is what she's doing legal?

Thank You

Without knowing more about the merits of the unrelated lawsuit your landlord threatened, it may be an unlawful retaliation and/or abuse of process. Retain an attorney or seek assistance from your local legal aid office whose number can be found in your Yellow pages under attorneys or from the clerk of court where you obtained the small claims judgment.
