Legal Question in Landlord & Tenant Law in Massachusetts
I own a two family and both apartments are being rented under a year lease. I need to move out of my current residence. Can I remove one of the tenants if I need one the apartment for myself and my two kids?

Assuming that you and your tenants have entered into a valid lease for a term, you can only commence eviction proceedings against your tenants for non-payment, or some other breach of the lease by your tenants. Otherwise, you are contractually bound to honor the lease. Are you sure your lease isn't a month-to-month lease? Have you tried speaking with your tenants? Do you have grounds to claim breach of the lease? Are they behind in their payments?
Bring your paperwork to a lawyer for a consultation and to figure out your options.
