Legal Question in Landlord & Tenant Law in Massachusetts

Finding a replacement on a lease

Hi,

I signed a lease with 2 other people which started on June 1, although I was not going to move in until September, and a subletter was found. For personal reasons, I no longer want to live with these people, and have volunteered to help them find a replacement, and pay a month of rent to provide them with enough time once their subletter leaves. They have said that I have to move in, as my name is on the lease, and that if I don't, I will be responsible for my rent as they are not open to the idea of taking in a different tenant. Legally, if I find a replacement, could they sue me for breaking my lease since they refuse to take that person on in my stead?

Thanks,

Sam

Re: Finding a replacement on a lease

Whether or not you can find a replacement is between you and your landlord. In the end, you are obligated to pay rent to him or her - not to your co-tenants. You did not sign a lease with your co-tenants, you signed a lease with your landlord.

If your landlord is okay with you subletting or assigning your lease to another person, then you should help your co-tenants find a new roommate they are comfortable with.

If I can provide any further assistance in this matter, or if you would like me to review your current lease and obligations, please do not hesitate to contact me.
