Interest on Last Month and Security Dep
Landlord's real estate agent held our security deposit and last month's rent for 6 months before we moved in and did not pay interest now that we moved out. Landlord did pay interest for the months that it was in her possession (after real estate company gave it to her) and returned money properly. We want to sue to get interest from real estate company. They claimed they held it in a non-interest bearing account and will not pay. We believe MGL says landlord and ''agent'' must pay interest at ''5% or lesser amount'' but certainly not zero percent. MGL also says if they do not pay within 30 days we get ''three times'' amount as a penalty. Is the law on our side? Will you represent us?

You do have the law on your side, and I would suggest that you file a small claims case in your local district court. I would probably file against both the landlord and the rental company.
The amount of money involved is probably too small to warrant the expense of an attorney, but it never hurts to ask. Good luck!
