Legal Question in Landlord & Tenant Law in Massachusetts
My landlord rented the apartment above us. I live on the first floor with my mother. My mother is 96 and is on SSI and Pension. I am on SSDI. The people that he rented the other apartment to have 3 young girls. The mother is stay at home. The boyfriend works. I think I know what all that's about. The children make excessive noise by running and banging upstairs.They have not been out of the apartment for 3 days. Can this be deemed hardship on my mother and myself? Can I break the lease? Can I hold money back. What rights do I have as a tenant?

Read your lease to see if it defines quiet enjoyment and retain an attorney to contact your landlord to register a complaint that the noise from upstairs must stop or it will be considered a breach of your quiet enjoyment. Good Luck!
