You have the right to demand that your lease agreement be complied with and honored. You have the right to proper eviction process. You have the right to assert any available defenses and counterclaims. You have the right to expect that your security deposit and last month's rent payments have been properly transferred to your new landlord.
If you are being evicted, you may want to contact an attorney.
Unless you have an unexpired written lease, your landlord can serve you with a 30 day notice to quit (with no reason needed) or a 14 day notice if your rent is in arrears.
You have rights to insist proper eviction process is followed and can raise any defenses or counterclaims you may have in any court eviction action properly served upon you. You may also ask the court for a stay of eviction execution for up to six months to find a new rental for you and your minor child as long as your rent is maintained current.
You should retain an attorney to advise you more specifically whether any eviction notice served on you is proper and what specific defenses and or counterclaims you may have to any impending eviction action or whether your landlord may have failed to do something that might bar their right to evict you.
Good Luck!
